An escrow is an arrangement in which a disinterested third party such as Ruskin Title & Escrow, called an escrow holder or settlement agent, holds legal documents and funds on behalf of a buyer and seller, and distributes them according to the buyer’s and seller’s instructions.
When buying a home there is a presumption that the seller is in fact the owner and only person with legal authority to sell the property and the property is free of liens and encumbrances. A Florida judgment and lien search is used to confirm who the owner of the property is and determine if there are any unsatisfied judgments against a person and/or the property subject of the transaction.
Title insurance protects the buyer (policy holder) and lender against loss or damage due to defects in the title. Examples of a title defect can be judgment lien or tax lien against the owner or HOA and code enforcement lien against the property.
What is “For Sale By Owner”? For sale by owner (FSBO, pronounced “fiz-bo”) occurs when a home or building is sold by the owner without the help of a real estate listing agent or broker.
